Terms & Conditions

Welcome to Omnia WorkSpace (the "Software" or "Application"). These Terms and Conditions (the "Agreement") govern your use of Omnia, including its features, functionalities, and services. By accessing or using Omnia WorkSpace, you agree to be bound by these Terms. If you do not agree with any provision of this Agreement, you must discontinue use immediately.

 

Definitions

  • Omnia: The software application provides workspace management, multi-application control, and live app embedding features.

  • User: Any individual or entity accessing or using Omnia.

  • Company: The owner and operator of Omnia.

  • Services: All functionalities and features provided by Omnia, including embedded browsing, application control, automation, and workspace management.

  • Subscription Plan: A paid or free tier of access to Omnia’s features.

 

Acceptable Use Policy

  • Authorized Use

    • Users agree to utilize Omnia solely for lawful purposes, in compliance with applicable local, national, and international laws.

    • Users must not reverse engineering, modify, or tamper with the Software’s code, features, or infrastructure.

    • Users must not use Omnia to access or control applications without proper authorization.

  • Prohibited Activities

    • Users are strictly prohibited from:

    • Unauthorized Access: Using Omnia to control or interact with applications they do not own or have permission to access.

    • Privacy Violations: Capturing, recording, or mirroring content from third-party applications without consent.

    • Malicious Use: Engaging in fraudulent, deceptive, or illegal activities, including hacking, phishing, or unauthorized surveillance.

    • Distribution & Resale: Reselling, sublicensing, or distributing Omnia without written permission from the Company.

 

License and Intellectual Property

  • License Grant

    • The Company grants Users a limited, non-exclusive, non-transferable, and revocable license to use Omnia in accordance with this Agreement.

  • Ownership Rights

    • All intellectual property rights, including copyrights, trademarks, patents, and trade secrets related to Omnia, are exclusively owned by the Company. Users do not acquire any ownership interest in Omnia by using the Software.

  • Restrictions

    • Users may not copy, modify, decompile, or reverse-engineer any part of Omnia. Any attempt to bypass security measures or perform unauthorized integrations is strictly prohibited.

 

Privacy and Data Collection

 

  • User Data

    • Omnia collects limited usage data to enhance performance and security.

    • No personal browsing data or login credentials from third-party applications are stored.

  • Third-Party Applications

    • Omnia may interact with third-party applications; however, the Company does not control their privacy policies. Users are responsible for reviewing and complying with the privacy terms of any third-party services accessed through Omnia.

  • Security Measures

    • Industry-standard encryption and security protocols are implemented to protect user data.

    • Users acknowledge that no system is completely immune to cyber threats.

 

Compliance & Legal Requirements

 

  • GDPR & CCPA Compliance

    • Omnia complies with the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) where applicable. Users have the right to:

      • Request data deletion (where applicable).

      • Opt-out of data collection for marketing or analytics.

  • Regulatory Compliance

    • Users must ensure they comply with any industry-specific regulations when using Omnia for business or professional purposes (e.g., HIPAA for healthcare, SOC 2 for enterprise security).

  • Legal Liability

    • The Company is not responsible for any misuse, unauthorized access, or privacy violations caused by the User.

    • Users assume full responsibility for ensuring their use of Omnia complies with local and international laws.

 

Subscriptions, Billing, and Refunds

 

  • Subscription Plans

    • Omnia offers free and paid tiers with varying levels of access and functionality.

    • Users must adhere to the terms of their selected subscription plan.

  • Payment Terms

    • All payments are non-refundable unless otherwise specified.

    • The Company reserves the right to modify subscription pricing with prior notice.

  • Account Termination

    • The Company reserves the right to terminate or suspend any User account for violations of these Terms without a refund.

 

Service Level Agreement (SLA) for Enterprise Users

 

  • Uptime Commitment

    • The Company guarantees 99.9% uptime per month for enterprise users.

    • Exclusions: Scheduled maintenance, force majeure events, or user-caused errors.

  • Support & Response Time

    • Standard Issues: Response within 8 business hours.

    • High-Priority Issues (Enterprise Plans Only): Response within 2 business hours.

    • Support Channels: Email, chat, and phone support available 24/7 for enterprise users.

 

Warranties & Disclaimers

  • No Warranties

    • Omnia is provided "as is" and "as available" without warranties of any kind. The Company does not guarantee uninterrupted or error-free service.

  • Limitation of Liability

    • The Company shall not be liable for:

      • Loss of data, revenue, or business opportunities resulting from Omnia’s use.

      • Security breaches or unauthorized access due to user negligence.

      • Legal consequences of unauthorized third-party application control or monitoring.

Governing Law & Dispute Resolution

 

  • Jurisdiction

    • These Terms are governed by the laws of the Commonwealth of Virginia, USA.

  • Arbitration Clause

    • Any disputes must be resolved through binding arbitration rather than court litigation.

    • Users waive the right to participate in class-action lawsuits against the Company.

  • Amendments & Termination

    • The Company reserves the right to update these Terms at any time.

    • Continued use of Omnia constitutes acceptance of any changes.

    • Users may terminate their use of Omnia at any time, but no refunds will be provided unless required by law.
